TOLES Higher is the second main level. It is a secure, proctored online exam lasting 90 minutes, with ten sections and 95 questions. The current paper is entirely multiple choice and tests legal-English reading and writing skills at intermediate to upper-intermediate level.
The exam is intended for candidates with above-Foundation commercial legal English and at least intermediate general English, approximately B1+. Multiple choice does not make the task easy. Options can differ through collocation, grammar, register or a subtle legal distinction, so successful candidates must recognise the standard expression rather than merely understand the topic.

The syllabus covers the same broad commercial areas as the TOLES progression: court cases, banking and loans, contracts, business structures, insolvency, disputes, landlord and tenant, tortious liability, employment, intellectual property, alternative dispute resolution and common-law operation. At Higher, texts and scenarios become more complex and require more dependable language control.
Build vocabulary in networks. For “contract,” learn enter into, perform, breach, vary, assign, rescind and terminate, then distinguish when each is appropriate. For litigation, connect cause of action, issue proceedings, serve documents, settle a claim and enforce judgment. Compare British legal usage with variants only when relevant to the exam material.
Grammar practice should target meaning: obligations through shall, must and may; conditions and exceptions; passive structures; reference across clauses; nominalisation; and prepositions fixed by legal collocation. Read the full sentence and surrounding context before choosing.
Use elimination carefully. Reject an option because of evidence—wrong part of speech, nonstandard collocation, incorrect legal relationship or unsuitable register—not because another “sounds more formal.” Legal English values precision, and unnecessary archaism is not automatically correct.

Timed practice should develop a steady pace with a reserve for review. Mark uncertain items mentally and return if the platform permits. After practice, explain every alternative. A practical preparation method
Begin with the free official example for the intended level. Learn language as lawyers use it in clauses, correspondence and commercial situations—not as disconnected word lists.
Review requires evidence. For multiple-choice questions, explain why the selected option fits the grammar, meaning and professional context and why each distractor fails. For free-text items, check spelling, form, precision and whether the expression is the standard legal collocation. Rewrite difficult sentences in clearer modern legal English without changing legal effect.
Complete a realistic online simulation regularly. Reproduce the intended 90- or 120-minute limit, secure-browser behaviour, typing and proctoring conditions. Use no unauthorised references. Afterwards, separate language problems from interface and concentration problems, correct one pattern, and repeat a related set under time.
Track evidence rather than mood: percentage, accuracy by topic, time per section, repeated grammar errors and vocabulary successfully recalled in context. In the final week, revisit proven material, complete technical checks, confirm identification and appointment details and protect sleep. Official TOLES guidance overrides unofficial shortcuts.

Keep professional usefulness at the centre of study. Ask whether each new expression helps you interpret a clause, explain a legal relationship, draft more clearly or avoid ambiguity. This makes exam preparation valuable beyond the certificate itself.
