Choosing the correct TOLES level is the first preparation decision. The three certificates form a progression, but candidates are not required to begin at Foundation if their existing legal English supports a higher entry point. The official interactive examples are more reliable than choosing by job title or years of legal experience.

Foundation suits candidates who have just started commercial legal English. It tests elementary to lower-intermediate grammar and core legal vocabulary. A qualified lawyer may still benefit from Foundation if English contract language and common-law terminology are new.

Higher requires broader vocabulary, stronger grammatical control and the ability to handle more complex legal situations and documents. Its official guidance expects above-Foundation commercial legal English and at least intermediate general English. Because all 95 questions are multiple choice, precision between closely related options becomes important.

Advanced is intended for candidates with a good level of commercial legal English and upper-intermediate or advanced general English. It places greater emphasis on sophisticated vocabulary, grammar, register, drafting preferences and accurate work under time pressure. Thirty of its 140 questions require typed free-text answers, which removes the support of options.

Do not interpret A2+, B1+ and B2+ as formal TOLES alignment to the CEFR. They are entry guidance about general English, while TOLES measures a specialist professional register. A candidate with strong conversational English may still lack contract collocations; a lawyer with excellent terminology may still make costly grammar errors.

Notice which legal topics are unfamiliar, whether grammar decisions are reliable, how quickly documents can be processed and whether free-text expressions can be recalled accurately. The best choice is credible and useful. A strong Foundation or Higher result may demonstrate more genuine competence than a weak Advanced attempt. Progression should be based on evidence, study time and professional needs rather than prestige alone.

A practical preparation method

Begin with the free official example for the intended level. Work under time, then classify every error: unfamiliar legal term, collocation, grammar, document structure, common-law concept, misleading option, typing or time management. Record uncertain correct answers too. A percentage alone cannot show which language behaviour should change.

Use five focused sessions each week. Rotate vocabulary, grammar, legal reading, contract language and timed question practice. Keep an active notebook with the term, plain-English meaning, common collocations, contrast with a near-synonym and one authentic sentence. Learn language as lawyers use it in clauses, correspondence and commercial situations—not as disconnected word lists.

Review requires evidence. For multiple-choice questions, explain why the selected option fits the grammar, meaning and professional context and why each distractor fails. For free-text items, check spelling, form, precision and whether the expression is the standard legal collocation. Rewrite difficult sentences in clearer modern legal English without changing legal effect.

Complete a realistic online simulation regularly. Reproduce the intended 90- or 120-minute limit, secure-browser behaviour, typing and proctoring conditions. Use no unauthorised references. Afterwards, separate language problems from interface and concentration problems, correct one pattern, and repeat a related set under time.

Track evidence rather than mood: percentage, accuracy by topic, time per section, repeated grammar errors and vocabulary successfully recalled in context. In the final week, revisit proven material, complete technical checks, confirm identification and appointment details and protect sleep. Official TOLES guidance overrides unofficial shortcuts.
